after a petition was filed in the Calcutta High Court after a student’s application for JEE Advanced 2021 was rejected. The basis for this rejection was that the student had already secured admission to IIT Kharagpur in 2020. This position is mentioned in Criterion 5 of JEE Advanced 2021 Information Brochure. The Calcutta High Court had held that there is no bar on a non-IIT student from appearing in the examination but an IIT student is barred from appearing for the examination. Such a situation was clearly discriminatory as the students were not getting fair and equal opportunities.
What did the Supreme Court say?
Setting aside the High Court’s decision, the Supreme Court held that the criterion was valid and justified as it aims to ‘preserve the valuable public resource of IIT seats’. Because of this, the whole idea behind classifying IITs and non-IITs is also valid and necessary. It further said that all academic matters should be left to the subject experts and the interference of the legal world should be minimized in every possible way.
